LexisNexis Publishes an Overview of the AMCA Arbitration Rules
The globally leading provider of legal information and analytics, LexisNexis Legal & Professional, has published in its online database, LexisNexis, an article prepared by the Arbitration and Mediation Center of Armenia on the specific features of the Center’s Arbitration Rules.
The article, in particular, the key provisions of the Rules, electronic communications and the possibility of conducting remote hearings, the specific features of the formation of arbitral tribunals, regulations concerning third-party funding, expedited procedures, consolidation of arbitral proceedings, arbitration costs, termination of proceedings, as well as other innovative provisions provided by the Rules.
For instance, the article discusses Article 25 of the Arbitration Rules, noting that, in line with recent international developments, the Rules require parties to disclose the existence of any third-party funding arrangement and the identity of the third-party funder either in the request for arbitration or immediately after concluding a funding agreement with a third party.
The article also emphasizes that the Rules allow the Arbitration Council of the Center, upon the request of one of the parties, to consolidate two or more arbitration proceedings conducted under the Rules into a single arbitration if:
(1) the parties have agreed to consolidation; or
(2) all claims in the arbitrations are based on the same arbitration agreement or agreements; or
(3) the claims are not based on the same arbitration agreement or agreements, but the parties are identical, the disputes arise from the same legal relationship, and the Arbitration Council finds the arbitration agreements to be compatible.
In such cases, unless otherwise agreed by all parties, the arbitrations shall be consolidated into the proceeding that was commenced first.
According to the authors, this regulation aims to reduce unnecessary procedural burden, lower costs, and minimize the risk of inconsistent arbitral awards.
